Conditional Discharge Given to Workshop for Using Unsafe Gas Heater

HSE has moved the Stafford Magistrates Court to issue a conditional discharge to a motor mechanics workshop for continuing to use a gas heater which released harmful fumes.

On 3 December 2009, an inspector from HSE had cautioned the workshop in question, Garage Bow Street Ltd. located in Staffordshire against using its Powrmatic gas heater. When in use, the heater was found emitting carbon monoxide through the exhaust flue. Since it could cause health and safety problems to client and residents living in the workshop’s immediate vicinity, the inspector issues a Prohibition Notice ordering the garage to discontinue using the dangerous gas heater.

The notice pointed out that the electrical wiring was inadequate and the exhaust flue was laid inside the building. In addition to this, the notice stressed on the requirement for a thorough servicing of the wiring system by an able gas engineer.

However on returning to the workshop after a month, the HSE inspector felt that the garage was relatively warmer. The heater was turned off when Ian Moore, a director at Garage Bow Street Ltd. noticed the inspector. He explained that oil had spilled over the floor and they were running the unit for 45 minutes to dry the floor after swabbing it.

The workshop was issued a six months conditional discharge for failing to comply with Section 33(1)(g) of the Health and Safety at Work etc. Act 1974. The court also instructed them to pay costs amounting to 500 since the company no longer engaged in trading.

Andrew Bowker, an inspector with HSE stated that the company showed a blatant disregard for the safety of others. Around 20 people die every year from carbon monoxide poisoning as a result of a poorly installed or maintained gas appliances and flues. He explained that it was important to get the installation, servicing and maintenance of gas appliances done by a competent gas engineer and in line with manufacturers’ instructions. Failing to do so could lead to devastating consequences.
